Your privacy is important to me. I provide this notice to explain my online information practices and the choices you can make about the way your information is collected and used. This notice applies to all information collected or submitted on the Donna Vie Photography website.
The only personal information I collect is name, mailing address, email, and telephone number. Your credit card information will also be collected if that form of payment is used to make your purchase but, that data is only used to process your transaction and is not stored in my database.
I use the personal information collected from you to facilitate taking your photographs, communicating with you regarding your photographs and other related products and services, and processing any transaction you may do with Donna Vie Photography. Such personal information as I collect is not used for any other purpose and is not shared.
I never use or share the personally identifiable information provided to me online in ways unrelated to the ones described above.
To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, I have put into place appropriate physical, electronic, and managerial procedures to safeguard and secure the information I collect online.
Protecting the privacy of the very young is particularly important to Donna Vie Photography. For that reason, I never collect or maintain information at my website from those we actually know are under the age of 13, and no part of my website is structured to attract anyone under 13 to provide information to me.
You can correct factual errors in your personally identifiable information by sending me a request detailing the error(s). To protect your privacy and security, I will also take reasonable steps to verify your identity before granting access or making corrections. In the unlikely event any of the personal information you supply me online is misused, you may redress these issues by contacting me directly at firstname.lastname@example.org.
terms and conditions
Entire Agreement This agreement contains the entire understanding between Donna Vie Photography and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing and signed by all parties involved. This Agreement shall be governed by the laws of the State of Nevada.
Payment & Prices The retainer must be paid in full at the time of booking. Retainer secures the time and services of the Photographer for the session and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the Photographer due to cancellation. Sessions that are postponed to a later date will retain the fee as long as the Photographer can re-schedule for the new date and time.
Following payment of the retainer, balance of any fees due is to be paid before the date of the session or two weeks before the event or wedding date. No photographs will be delivered until all payments due have been paid in full. Payment for additional images, albums and retouches is to be made when they are ordered.
Reschedule Due to the time specific nature of this service, Clients may not reschedule under any circumstance.
Torrential Weather If the weather is torrential and Photographer determines shoot is not possible, the session will be rescheduled for another day.
Personal Camera Client may not bring own camera or recording equipment to the session. If a camera is present, Photographer will have to request that it be put away.
Personal Assistants Client may not invite or include other persons to the session that are not listed to be photographed unless communicated in writing at least 24 hours prior to the session.
Requested Coverage Donna Vie Photography will honor requested photographs but does not guarantee any specific photographs.
Split Coverage Clients are subject to an additional fee if there is a wide timeframe gap. For example, the ceremony is in the morning and the reception is in the evening. I do not schedule other sessions or weddings on the same day (exceptions apply), so the Client will have and compensate for my full undivided attention on their day.
Continuous Coverage Event bookings are required to be continuous coverage and cannot be split. For example, the ceremony is in the morning and the reception is in the evening. The hours in between will count towards the paid coverage. If the Client books 8 hours of coverage, there will be no gaps unless it’s for meal or bathroom breaks.
Artistic Style Client acknowledges that she/he has viewed examples of previous work and is satisfied with the overall style of photography that is presented. Client understands that differences in locations, subjects and lighting allow for variations in the final outcome of the session. There is no knowing what photos will be produced from this endeavor simply because this is an event in the future. Photographer reserves the right to artistically interpret how to photograph a scene. This may mean that some shots are color and some may be black and white.
Retouching All images will be adjusted for skin blemishes, exposure, brightness, contrast, sharpness, etc. The Photographer’s judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Photographer is not responsible to fix hair or skin, or makeup problems. It is understood that Photographer is not responsible to fix photos to cover parts of your body that you do not wish to be seen in the photo, unless it was confirmed with the Photographer in writing. Retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost.
Client Usage The Client is obtaining prints for personal use only, and shall not sell paid prints or authorize any reproductions thereof by parties other than the Photographer. Without permission from the Photographer, the Client shall not download, copy, print, screen shot, use as a basis for derivative works, manipulate in any way, or otherwise use the Photographer’s images.
If Client is obtaining a print for reproduction or publication, Photographer authorizes Client to reproduce the print only as agreed upon by Client and Photographer. In such event, Client shall request that a credit for the Photographer be placed adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to do so.
Social Media This clause applies to all social media, including but not limited to Facebook, Instagram and blogs. When published online it is required that citation of Photographer be made. The Client agrees that they will under no circumstances alter any photographs that are placed in public on the internet. The Client agrees to be responsible for any family member or friend who posts my photographs online and agrees that they cannot be cropped (with the exception of the forced cropping for Facebook’s Timeline), altered in color, or edited in any way.
Cooperation & Physical Liability All parties agree to joyful cooperation and communication for the best possible result within the definition of this Assignment. Photographer is not responsible for missed images due to any individual’s failure to appear or cooperate during the Assignment. If there is any threat to the Photographer or their equipment by any subject, Photographer reserves the right to end coverage immediately with no further liability to finish the Assignment, with no refunds given. Additionally, Client is responsible for their own conduct and the conduct of all participants in the session. Any damage to equipment caused by the Client are the sole financial responsibility of the Client. Client agrees to hold Photographer harmless for any injuries or damages sustained preceding, during, and immediately following the Assignment.
Copyright & Reproductions All photographic materials, including but not limited to digital files, negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions.
Photographer The Photographer may substitute another photographer to take the photographs in the event of Photographer’s illness or personal crisis. In the event of such substitution, Photographer warrants that the photographer taking the photographs shall be a competent professional.
Limit of Liability In the unlikely event that the Photographer cannot perform this Agreement due to a medical or natural emergency, or other cause beyond the control of the Photographer, then the Photographer shall return the retainer to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
Meals Photographer suggests that Client shall provide a suitable meal (not necessarily the banquet meal served to guests) for the Photographer’s if the contracted coverage extends through a seated meal service AND the contracted coverage is four or more hours. It is also suggested that the Photographers eat directly after the party guests so that they may be ready to go when activities begin again.
Inherent Qualities Client is aware that color dyes in photographs and photography products may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.
Storage of Images Original digital images are kept on an active file for 3 weeks post delivery, after which time they will be deleted unless expressly stated otherwise by Donna Vie Photography.
Complaints Any complaints should first be raised by the Client with the Photographers in writing within 3 days (72 hours) from the date of receipt of images.
